GENERAL TERMS AND CONDITIONS FOR USING THE SERVICES OF TED.BG

Please read these General Conditions carefully before using this website. If you use this website, you are deemed to have accepted and agreed to the following General Conditions.

These GENERAL CONDITIONS govern the relations between TED BED EAD (hereinafter referred to as ted.bg) on the one hand and the Users of electronic (Internet) pages and services, located on the ted.bg domain (hereinafter referred to as the Site), and the relations between the same when using information and commercial services offered by TED BED EAD (hereinafter referred to as Services).
These general conditions are binding for all the users who make a registration on the site ted.bg. By clicking on each object, link or button, located on the pages of ted.bg (with the exception of the link to these General conditions), the user agrees, fully accepts and undertakes to comply with the present General Conditions.
TED BED EAD is a company registered in the Republic of Bulgaria, with registered office and address of management: city of Plovdiv, Blvd. "6ti Septemvri" 222 a; entered into the Registry agency with UIC: 200908653.

1. Conditions for using the Site ted.bg

The user understands and agrees with the fact that the information services and the Site are provided "in the way they are published".
The user is informed and agrees that part of the goods, published on the Site, may be referred to as available in the chain of shops, but actually, these goods and products, as well as their accessories may be unavailable when placing an order for those goods through the online purchasing system.
The user is informed and agrees that his/her requested order may undergo changes that ted.bg undertakes to notify the user of on the email address and/or telephone number provided by him/her and/or in some other appropriate manner until receipt of confirmation about the final shipment of the confirmed order to the address of the user.

2. Obligations of the user upon registration

For the purposes of use of the Site ted.bg, the User agrees and declares that he/she will provide true, accurate, current and complete information when filling out the registration form (hereinafter referred to generally as Personal data); In the event that the User provides false, inaccurate, not current or incomplete information, ted.bg has the right to close and/or delete the information about his mailing address and to refuse further access to part or all of its services, as well as ted.bg shall not be responsibility for a false and/or inaccurately executed order, carried out in connection with the information received by the user.

3. Personal Data Protection

TED BED EAD processes personal data, received when operating its website https://ted.bg, in accordance with the Regulation (EC) 2016/679 ("GDPR") provisions and the related legal framework, including the Personal Data Protection Act.

3.1. PERSONAL DATA DEFINITION

"Personal data" means any information relating to an identifiable natural person or a natural person ("data subject"); an identifiable natural person is a person who can be identified, directly or indirectly, in particular by an identifier such as name, identification number, location data, online identifier or one or more signs specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that individual.

3.2. TYPE OF PROCESSED PERSONAL DATAThe categories of personal data being processed are "standard" personal data like name, e-mail, address, IP address, phone number, e-mail, etc.

3.3. PURPOSE OF PERSONAL DATA RECEIPT TED BED EAD objectives for personal data processing are:

For the purposes of our e-shop management activities:
processing of order(s) received from the TED BED EAD electronic shop in accordance with concluded contract
maintenance and support of certain offered services features
the advertising of TED BED EAD goods and services.

We use personal data to help us developing, delivering and improving our products, services, content and advertising.
We may occasionally use your personal information to send important messages such as notifications about your purchases and our policy changes and terms.
It is likely also to use your personal information for internal purposes such as checks, data analysis, and for TED BED EAD research to improve product and customer services.

3.4. LEGAL GROUNDS FOR PERSONAL DATA PROCESSING Personal data processing is based on the consent of the personal data subject, according to the provision of Regulation (EU) 2016/679, Art. 6 (1) (a), namely that the data subject gives their consent for their personal data processing for the explicit purposes stated. The processing is also necessary for the implementation of the offered service, according to Art. 6 (1) (b).

3.5. CASES OF PERSONAL DATA DISCLOSUREIn certain cases TED BED EAD may disclose personal data to its partners that provide products and services related to the Company's activities or to assist TED BED EAD in customers’ marketing. Personal information shall be disclosed only in order to improve our products, services and advertising; the same won’t be shared with third parties for their marketing purposes. TED BED EAD may disclose your personal data to third parties when required by law, in a lawsuit, in a litigation and/or upon request by public and governmental authorities in or outside the country of residence. We may also disclose personal data if we find that such disclosure is necessary or appropriate for the purposes of national security, law enforcement or other matters of public concern.

3.6. PERSONAL DATA TRANSFER IN THIRD COUNTRIESAs a rule, TED BED EAD does not transfer personal data to third countries outside the EU. In some cases, your data may be transferred to third parties for the execution of a contract between TED BED EAD and a company acting as a service provider. In these cases, TED BED EAD ensures that this transfer is carried out in full compliance with the respective level of personal data protection, provided by Regulation (EC) 2016/679 (GDPR).

3.7. PERSONAL DATA RETENTION PERIODThe retention period for storing your personal data is six years from the date of your consent.

3.8. MEASURES TAKEN TO PROTECT YOUR PERSONAL DATAThe security measures that apply to personal data protection are: implementing, both at the time of identifying the means of processing and at the time of processing itself, the appropriate technical and organizational measures designed to effectively apply data protection principles, such as minimizing data, integrating the necessary safeguards into the processing process, as well as introducing appropriate technical and organizational measures to ensure that the personal data is handed by default only when needed for any particular purpose of processing.

3.9. WHAT ARE YOUR RIGHTS?With regard to personal data collection and processing, you have the following rights:

You are entitled to request a copy of your personal data and to have access at any time to your personal data.
You are entitled to transfer your personal data to another data administrator without any hindering or impediment from our side.
You are entitled to request us to correct, without unnecessary delay, inaccurate personal data and data that need to be updated. For the purpose of correcting or supplementing your personal data, you must submit a separate declaration stating current personal data;
You have the right to request your personal data to be deleted without further delay in any of the following circumstances: your personal data are no longer necessary for the purposes of which they were collected; in case you withdraw your consent; when you object data processing if the same are found to be unlawful; when personal data must be erased in order to comply with a legal obligation under Union law or the law of a Member State applicable to the Data Controller; in case personal data were gathered with a view of offering services to information society.
Your personal data may NOT be deleted for any of the following reasons:

(A) Use the right for free self-expressing and the right to information;

(B) Compliance with a Data Controller legal obligation about the performance of a task of public interest or exercising official authority conferred on the Controller;

(D) For the purposes of archiving that is of public interest, for scientific or historical research or for statistical purposes, insofar as erasure is likely to make it impossible or seriously obstructing attainment of the purposes of such processing; or for the establishment, exercise or protection of legal claims.

You have the right to ask your data administrator to restrict the processing of your personal data, in which case the data will only be stored but not processed.
You have the right to withdraw your consent for processing your personal data at any time by applying a separate declaration in our office.
You are entitled to object the processing of your personal data and the competent authority to be addressed is the Personal Data Protection Commission, address: 2, Prof. Tzvetan Lazarov Str. Sofia 1592 (www.cpdp.bg).
In case we need to use your personal data for a new purpose, not covered by these terms, we will provide you with a new data protection notice and, if necessary, we will require your prior consent for the new processing.

3.10. DATA PROCESSING CONSENT WITHDRAWAL CONSEQUENCESAny data subject is entitled to withdraw its consent for the processing of personal data at any time. Withdrawal of consent does not affect the lawfulness of processing prior to withdrawal. Withdrawal of data processing consent for the purposes mentioned above will result in TED BED EAD not being able to send you messages and publications for advertising, marketing and commercial purposes, as well as to contact you electronically on issues related to the client program.
Withdrawal of consent for the processing of above mentioned data will result in TED BED EAD not being able to contact its client on client-related issues by mobile phone and to send SMS messages and messages via Viber application for advertising, commercial, and marketing purposes.

4. Copyrights and restrictions associated with them

ted.bg provides the right to Users to use all the services that are listed on the Site only for private purposes and non-profit aim and under the condition that they do not violate the copyrights of ted.bg or of third parties related directly or indirectly with the materials of the Site. It is expressly prohibited the materials published on this Site to be copied, publicly distributed or given out for any purpose whatsoever by Users. The use of the materials published on this Site in other websites is prohibited and the violators are subject to penalties in accordance with the provisions laid down in the Law on the protection of copyright and related rights.
ted.bg reserves the right to assign the rights for publishing of materials and other information published on the Site, to third parties for an additional contract in writing, laying down the legal relations between the ted.bg and the person publishing the information.
When purchasing a product representing an object of copyright and/or patent rights ted.bg does not grant any additional rights for use and distribution, except the expressly mentioned rights and/or licenses from the manufacturer/distributor of the product.
All goods and services provided by ted.bg are protected under the Law on the protection of copyright and related rights are made available to the Users in their original form, packing, and carrier without any influence on the side of the ted.bg and according to the licenses and the distribution rights, given by their manufacturers and/or distributors for the Republic of Bulgaria.

5. Goods and services presented on the Site

The information about the goods on the Site is divided into types of groups and sub-groups; In the page (link) to each item, referred to in the Site, information is given about the price, the main features of the product and additional information supporting the process of making informed choices by the Users when buying a product.
ted.bg reserves the right to publish names, models and other information about the goods in English when:
a) There is a danger that valuable information regarding the characteristics of the goods may be lost in the translation;
b) There is no unambiguous accepted terminology in Bulgarian;All prices indicated on the site are in BGN inclusive of VAT.
ted.bg has the right at any time and without notice to make changes to the published products, services, prices, and other characteristics of the goods and the Users are considered informed about the indicated changes from the date of their publication. The information about some of the published products may not be updated, but in all cases, the Users will be notified before the delivery in case they place an order on the Site with the online form for purchases about the outdated information on the Site, related to the ordered products. ted.bg is not responsible if due to a technical or technological problem, or lack of the necessary materials, it fails to fulfill the order made through the Site.

6. Purchasing a product and/or service, presented on ted.bg

The user has the right to order all the goods and services listed on the Site of ted.bg. At the time of placing the order the User has the right to choose the type of goods and their quantity, the manner and terms for delivery, according to the given Site options.
At any time before the final confirmation of the Order by filling out the form for online purchasing, the User has the right to make changes to the selected goods and services.
When placing an order on the site the User enters into a contractual relationship with TED BED EAD, concerning the specific order and governed by these General conditions, the order is deemed to be permanently affected after receipt of order confirmation, following the instructions are given on the Site;
ted.bg has the right to change the prices indicated on the Site at its sole discretion, at any time and without the obligation for prior notice to Users. The User is obliged to pay the price, which was referred to on the Site during placing the order, whether it is lower or higher than the updated price. In case of technical errors in the information published on the Site, with the result that the order cannot be executed, ted.bg has the right to refuse execution of the order and does not owe any other damages to the User, except recovery of the sums paid and/or deposited by the user for the cancelled order, if any.

7. Delivery of purchased goods

The deadline for delivery of the goods stated in the order to your home is within 20 working days after receipt of confirmation of the order, and the deadline may be extended in public holidays and/or weekends with the duration of the non-working days. In all cases a delay in the delivery is possible but you will be notified promptly about it by our associate.
The delivery of the ordered goods is carried out in the way selected by the User and according to the indicated time limits. ted.bg reserves the right to extend the said time limits, and the Users shall be informed in advance about it by an associate of TED BED EAD.
The delivery of the products ordered by ted.bg is free of charge for orders over BGN 50 and in the amount of BGN 5 for orders under BGN 50, if it is made on the territory of the Republic of Bulgaria, except for the cases in which the Users are informed by an associate of TED BED EAD that a change of this condition had occurred and under the special conditions described on the product page. The delivery is made to the address of the customer, and TED and the partner courier company do not undertake to transport the product to the front door (in multi-family buildings) or to bring the product into the customer's home.
ted.bg may require additional confirmation, including by phone, fax, email of the order made. In the event that the User refuses to provide the information required by ted.bg, the refusal for the provision automatically leads to cancellation of the order, with or without further notice to the User.
The cost of delivery is listed under the information published for the item and is calculated automatically in the value of the order.

In cases where ted.bg specifies in writing an exact date and time for delivery, this statement has a binding force. In cases of false or incorrect address, contact person and/or phone when filing the order, TED BED EAD is not liable for the improper performance of the order as a result of the provision of false information by the User.
Upon handing over the goods, the User or a third party designated by him, are obliged to sign the accompanying documents. A third person is considered any person who is not a holder of the application but accepts the goods upon delivery at the address for delivery indicated by the User.
In the event that the User cannot be found in the period of performance of the delivery at the address specified by him and/or access to the address for delivery is not granted ted.bg is released from its obligation to deliver the requested goods and the User loses his rights under the order made by him for the supply of goods.
When the delivered goods clearly do not correspond to the stated purchase order by the User, and it can be verified in plain inspection of the delivered goods, the User has the right to ask for a replacement of the delivered product with such that corresponds to the application he has made for purchasing goods within 24 hours of notification of such request to an associate from the Logistics Department or on tel: 070019600
ted.bg reserves the right to change the subcontractor performing the delivery without being obliged to inform the User in advance provided this does not reflect on the way and time limit of delivery.

8. Payment of purchased goods and services

When making a cash payment of ordered goods and services, the User is obliged to deposit at the time of delivery to ted.bg or his representative/subcontractor involved in the delivery, the full value of the delivered goods in accordance with the confirmed order. In the event that within 14 (fourteen) days from the date of delivery the User refuses the goods purchased partially or entirely, ted.bg is obliged to recover partially or entirely the deposited amount for their purchase. In the event that the User does not implement the right of refusal of goods or services purchased in the abovementioned period, ted.bg automatically transforms the deposit as payment for the value of the ordered goods or services.
When the payment is done by a bank transfer, the User shall deposit an amount equal to the value of the delivered goods in accordance with the confirmed order to the bank account of TED BED EAD referred to in the invoice generated and only after the deposit is confirmed as received and the bank account is validated with the corresponding amount, ted.bg performs the delivery of the ordered goods and services. In the event that within 14 (fourteen) days from the date of delivery the User refuses the goods purchased partially or entirely, ted.bg is obliged to recover partially or entirely the deposited amount for their purchase. In the event that the User does not implement the right of refusal of goods or services purchased in the abovementioned period, ted.bg automatically transforms the deposit as payment for the value of the ordered goods or services.
When paying via a virtual POS terminal, the User deposits an amount equal to the value of the delivered goods in accordance with the confirmed order via a virtual POS terminal and only after the transaction of the deposit is confirmed, ted.bg performs the delivery of the ordered goods and services. In the event that within 14 (fourteen) days from the date of delivery the User refuses the goods purchased partially or entirely, ted.bg is obliged to recover partially or entirely the deposited amount for their purchase. In the event that the User does not implement the right of refusal of goods or services purchased in the abovementioned period, ted.bg automatically transforms the deposit as payment for the value of the ordered goods or services.

9. Refusal of purchased goods

The User has the right to refuse and to request return of the ordered and purchased goods within 14 (fourteen) days from receipt of the goods at the address of delivery, in the event that the same are preserved with packaging undamaged (the packaging of the consignment may be opened), fully equipped and the goods are as received with the accompanying documentation (invoice and warranty card) and under the conditions set out in art. 55 of the Law on consumer protection. You must fill out and submit a return application to TED at https://ted.bg/en/terms . An attached return receipt, the document confirming the purchase and all products must be returned together. Without these documents, returned goods will be sent back to the sender. The amount will be confirmed after checking the returned shipment. The customer can use the products only in order to establish their nature, characteristics and proper functioning. If the team of ted.bg finds damage and a decrease in the value of products such as pollution, damage, etc., there will be a partial refund of the amounts, depending on the damage. We suggest customers to use the available option to return the goods by courier and use an insurance option. The period of refusal is 14 days from the date of receipt of the goods. To exercise the right of refusal, you must inform us of your name, address, and telephone number, and for your decision to opt out of the contract with a letter sent by regular mail. The courier shipment back to the factory is at the expense of the customer. You can use a standard form of refusal and if you would like to obtain one, write to [email protected], but this is not obligatory. To keep the deadline for refusal stated in the contract, it is sufficient to send your message for exercising the right of refusal before the expiry of the time limit for refusal under the contract.

* Exceptions from the right of withdrawal are possible when the customer has ordered an individual or specially designed purchase of products which are not part of the TED BED EAD standard product portfolio.

These products may include:

one or double sided mattresses with non-standard size;
mattress frames with non-standard size;
beds with non-standard size;
other products that can be ordered with a non-standard size.

10. Warranty service

With every order of products, subject to warranty service, ted.bg issues and provides to the User a proper warranty card with details of the product entered and all the warranty terms of the granted commercial warranty specified.
The user cannot invoke and loses his rights under the guarantee:
a) in case of a lost warranty card;

b) in case of damages caused by an improper operation;
c) in case of violations of the physical integrity of the product;
d) in case of a chemical, electrical and/or other effects not related to the normal use of the product;

The products and services referred to on this Site are restricted only to the General conditions specified in the Site with no provision of warranties other than those referred to, including commercial and targeted ones. The obligations of ed.bg in respect of the products and services offered in this Site are regulated by the relevant agreements with importers and/or distributors of the products presented.

11. Others

ted.bg has the right to change unilaterally all the conditions for delivery of the goods and any other information published on the Site, without prior notice to the User.
ted.bg reserves the right to send messages to the User, related to new products and services, with promotions and/or changes in the conditions and methods for delivery of the goods provided and any other information published on the Site.
Questions, inquiries and User's consultations may be carried out online through the Site of ted.bg at the contact form, or by an associate of the Logistics Department on tel: 070019600, within the working time: from 9:00 a.m. to 18:00 p.m., Monday to Friday.

These General conditions may be updated at any time without special notice to Users. ted.bg is not responsible in the event that the users did not familiarize themselves with the subsequent updates of the published General conditions on the Site.

When using the website of ed.bg, the Users are obliged to abide by these General conditions, as well as the legislation of the Republic of Bulgaria applicable to the goods and services provided on the Site, including the international legislation.
